- DUI stop: Was there a reasonable suspicion to stop your vehicle? Were there signs that suggested to the officer that the driver was impaired? If not, the evidence may be excluded and your case dismissed. This includes stops at roadblocks and sobriety checkpoints, which are common in Massachusetts.
- Field sobriety tests: Field sobriety tests must be administered by the officer according to the National Highway Traffic Safety Administration manual. A failure to follow this manual may prevent the results from being admissible.
- Blood tests: If you agreed to a blood test, it may be appropriate to look at whether the blood alcohol content was actually above the limit of .08 by having an independent lab retest the blood sample.
- Breath tests: Breath test machines that are not properly maintained, that are not properly calibrated or that were operated by someone without the proper certification, may give inaccurate results.
