Will mediation really make the divorce process quicker?

In Massachusetts, mediation has become a popular option for couples looking to speed up the divorce process. This alternative dispute resolution method allows spouses to work through their issues outside of the courtroom. 

Instead of battling in lengthy court hearings, couples can come to an agreement on important matters, such as child custody and property division, on their own terms. Many divorcing individuals wonder, though, if mediation will actually make the process that much quicker.

Controlling the timeline

One key advantage of mediation is that it allows couples to maintain control over the divorce timeline. In traditional divorce proceedings, the court sets the schedule, which can lead to delays as both parties wait for available court dates. Mediation, on the other hand, lets couples meet on their own terms and resolve issues more efficiently. This flexibility often helps reduce the time spent waiting for decisions.

Streamlined communication

Another benefit of mediation is its focus on communication and collaboration. When both parties are willing to work together, they can come to agreements faster than if they were fighting in court. Mediators guide discussions and keep both spouses focused on finding practical solutions. This collaborative approach can prevent the process from dragging on due to constant legal disputes or disagreements.

Filing for an uncontested divorce

Massachusetts law also allows couples who settle through mediation to file an uncontested divorce. An uncontested divorce typically moves through the system faster because there are no major issues for the court to resolve. This reduces the number of hearings and court appearances, speeding up the process.

It is important to note that mediation only works efficiently when both parties express commitment to resolve their differences. Even so, the emphasis on flexibility and collaboration that mediation provides can help many couples accelerate the process by weeks or even months.
